What Nebraska Law Defines as Drug Manufacturing
Nebraska Revised Statute 28-416(1) prohibits knowingly or intentionally manufacturing, distributing, delivering, or dispensing a controlled substance, or possessing one with intent to do any of those things. The statute reaches further than many people expect.
Nebraska’s Uniform Controlled Substances Act defines manufacturing broadly: producing, preparing, propagating, converting, or processing a controlled substance, including extraction from natural materials and chemical synthesis. Cultivating marijuana qualifies as production under that definition, meaning a grow operation can be prosecuted as manufacturing without a single laboratory chemical on the premises.
Prosecutors don’t need a finished drug to bring a charge. Possession with intent to manufacture can rest on ingredients, equipment, and circumstantial evidence combined. Many items that appear in these cases, including cold medications, solvents, scales, glassware, grow lights, and fertilizer, have entirely lawful uses. Their presence alone doesn’t establish a crime. The State must prove the accused knowingly participated and must connect that person to the alleged activity, not just to the location where it occurred.
